  • ARTIST CONTENT RELEASE & DISTRIBUTION AGREEMENT
  • This Artist Content Release & Distribution Agreement (“Agreement”) by and between:
  • GEMS IT Publishing
  • and
  • Artist / Content Owner:
  • That is submitting this content
  • 1. GRANT OF RIGHTS & CONSENT
  • The Artist hereby grants full permission and consent to GEMS IT, its affiliates, partners, successors, and assigns to:
  • Use, reproduce, distribute, publish, repost, edit, crop, modify, remix, promote, and display the Artist’s content
  • Across all current and future platforms, including but not limited to:
    • Instagram, Facebook, TikTok, YouTube, X (Twitter), Threads
    • Websites, email marketing, press releases
    • Streaming platforms, digital ads, flyers, and promotional materials
    • Podcasts, interviews, reels, shorts, and livestreams
  • This consent applies to both existing and future content provided or captured with the Artist’s knowledge.
  • 2. CONTENT COVERED
  • This Agreement includes but is not limited to:
  • Music recordings and audio clips
  • Music videos and visualizers
  • Photos and promotional images
  • Interviews (video or audio)
  • Live performance footage
  • Social media content, reels, stories, and clips
  • Written quotes, captions, and promotional copy
  • 3. OWNERSHIP
  • The Artist retains full ownership of their original intellectual property unless otherwise stated in a separate written agreement.
  • This Agreement does not transfer ownership, only usage rights for promotion, marketing, and distribution.
  • 4. COMPENSATION
  • Unpaid / Promotional Use:
  • Artist acknowledges that content may be used for promotional and marketing purposes without monetary compensation, unless otherwise agreed upon in writing.
  • 5. TERM
  • This Agreement shall remain in effect:
  • For a term of 2 years from the date of execution
  • Unless terminated in writing by either party with 30 days’ notice.
  • 6. NO DEFAMATION / MISREPRESENTATION
  • GEMS IT agrees not to use the Artist’s content in a way that is knowingly defamatory, misleading, or harmful to the Artist’s reputation.
  • 7. RELEASE OF LIABILITY
  • The Artist releases and holds harmless GEMS IT from any claims related to:
  • Use of likeness, voice, or performance
  • Copyright disputes for content the Artist represents they own or control
  • Promotional distribution under this Agreement
  • 8. GOVERNING LAW
  • This Agreement shall be governed and interpreted under the laws of the State of MISSISSIPPI
  • 9. ENTIRE AGREEMENT
  • This document represents the entire agreement between the parties and supersedes any prior oral or written agreements related to content use.
  • Any amendments must be made in writing and signed by both parties.
  • 10. SIGNATURES
  • Artist signature through submission of this form is valid.
